Term and conditions
PoketyPoke services are available to you under the following terms and conditions as revised from time to time by PoketyPoke. The current version of these terms and conditions will always be posted at www.PoketyPoke.com. If you should break the rules provided in this agreement, we may have to suspend or terminate your service.
1. Fees
You can always check www.PoketyPoke.com for our latest published prices and the prices that will be applied to your Account. When using the PoketyPoke service, your conference call dial in numbers and access codes will be used to connect you to the call. If you choose to dial into the PoketyPoke service, your Network Operator will charge you at your standard rate. Roaming charges may also be applied by your Network Operator in addition, if you should dial in while roaming.
We suggest you check the costs applied by your network operator for each of the above services. PoketyPoke is not responsible for any charges applied by your network operator.
PoketyPoke reserves the right to limit the use of the service if we find any unreasonable usage has occurred on the account at any time.
2. User Pin Number
You will be able to create a user pin number for your account once you have completed the registration process. It is your responsibility to maintain the confidentiality of your user pin number. You should notify us if you become aware of any unauthorized use of your user pin number, account use or any other breach of security.
3. Your Registration Responsibility
It is most important that PoketyPoke be able to rely on the information that you provide us about you, and therefore you must confirm that you have provided and will provide accurate, current, and complete information about yourself to us and agree to inform us if that information changes. Should we suspect that you have not done this, we may have to suspend or terminate your account. We will guard your information very carefully and will only use your information in accordance with our Privacy Policy.
4. Confidentiality
We will not disclose outwardly any of the information that has been designated to be confidential or that is obviously confidential in nature. By "Outwardly" we mean persons other than employees, representatives, or any third parties who need to receive the information to provide the service.
5. Personal Information
We guarantee that we will follow all relevant data protection laws and regulations. In particular, we will never make available any personal data without consent unless necessary in providing the service.
6. Protection
You will indemnify and hold us and our employees, officers, agents, and subsidiaries harmless from any expenses, damages, or losses, including any legal fees or consequential losses due to your use of the service. You may not reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes, any portion of the PoketyPoke service.
7. Services Modifications
We reserve the right to modify or discontinue, temporarily or permanently, the service, with or without notice and liability to anyone. We reserve the right to terminate your account, user pin number, password, or use of the service, and remove and discard any content within the service.
8. User Conduct
We at PoketyPoke cannot be held responsible for any of the connections, sound or content of any of your conference calls. Conference calls can be recorded and/or transcribed based on the user preferences setup in your account. It is the responsibility of the user to inform conference call participants if the call is being recorded.
9. PoketyPoke's Rights
The service and the software required to provide the service are the intellectual property of PoketyPoke and is protected by law. In joining our service, you agree that content contained in information presented to you through the PoketyPoke service is protected by copyright, trademark, patents and other proprietary rights and laws. You are prohibited from accessing the service through any other means than through the means provided to you by PoketyPoke.
10. Notices
Notices of any changes to the PoketyPoke service will be sent by email, SMS, or through our website. Feel free to contact us for any reason through any of the numbers provided in our contact information made available on our website or by sending an email to info@poketypoke.com.
11. PoketyPoke[Beta] Error Tracking
PoketyPoke reserves the right to automatically send logs from the service for error tracking purposes.
12. Service Disclaimer
Conference calls can be dropped or lost due to poor phone connection. In this event, you can call the toll free number to be reconnected to your running conference. Some calls may not be transcribed due to poor dictation, noisy environment, or language. You will be notified in your account for that particular call.
13. Limitation of Liability
We do not control the content and are therefore not responsible for any errors or omissions in any of the content we provide even if it is a result of negligence. We are not liable for any indirect loss or for loss of profits, goodwill, time use, data or other intangible losses.
